Suit Over Pa. Soldier's Death in Iraq Is Revived

A federal appeals court revived a lawsuit Thursday against a military contractor in the death of a Pittsburgh-area soldier who was electrocuted in his barracks shower at an Army base in Iraq.

Ryan Maseth

Staff Sgt. Ryan D. Maseth, 24, of Pittsburgh, Pa., died in Baghdad, Iraq, on Jan. 2, 2008 of injuries suffered in a non-combat related incident. He was assigned to the 1st Battalion, 5th Special Forces Group (Airborne), Fort Campbell, Ky. The incident is under investigation. According to the family, he was electrocuted while in the shower.


Spc. Donald Anthony Wilder died Jan. 8, 2006, in Manheim, Germany. He was 21. He died after hazing (beating) by a Masonic group within the military. Official cause of death was acute alcohol poisoning.

Wrongful-death lawsuit in Shaler soldier’s electrocution dismissed

The mother of a Shaler soldier electrocuted in Iraq said Monday she was “completely disappointed” and will appeal a federal judge’s decision to dismiss the wrongful death lawsuit against the company she claims is responsible.

Cheryl Harris of Cranberry said the case involving her son, Ryan Maseth, didn’t end when U.S. District Judge Nora Barry Fischer on Friday dismissed the lawsuit against KBR Inc., a Houston-based engineering and construction company that contracted to maintain Army barracks in Iraq.

“We won’t quit until there is nothing left to appeal,” Harris said. “I was told that if I wanted justice, it would have to be in a courtroom. We expected that justice would prevail, but (the judge’s dismissal) left me surprised and disappointed.”

Rulings eyed in Shaler soldier's electrocution in Iraq shower

If the lawyers on opposite sides of a federal wrongful death lawsuit agree on anything, it's that the other side is misinterpreting recent court rulings governing the liability of a private Defense contractor.

The parents of Army Staff Sgt. Ryan Maseth, 24, a native of Shaler, are suing KBR Inc. for the Jan. 2, 2008, death of their son while he showered on a military base in Iraq maintained by the company.

Cheryl Harris and Douglas Maseth say shoddy electrical work by KBR on a pump caused their son's electrocution. KBR contends that while it had the maintenance contract for the building, the Army decided not to make the building electrically safe.
